How to Get a Green Card

The United States government tightly controls its borders, especially when a foreign citizen wants to come to this country permanently. In order to legally reside in the United States, you must have a green card (or "immigration visa"). Getting a green card to work in the United States can be confusing, and the process can seem endless without an experienced and committed immigration lawyer to guide you through the sometimes years-long experience.

U.S. immigration law divides work visas into five different categories, and the application process and waiting period is different depending on the category. The categories are:

  • First preference: Workers of "extraordinary ability" (EB-1)
  • Second preference: Employees with advanced degrees or people with "exceptional ability" (EB-2)
  • Third preference: Experienced skilled workers, employees with college degrees, other workers who will do work for which no qualified American workers are available (EB-3)
  • Religious workers (EB-4)
  • Investor visas: For foreign citizens who have invested or will invest a certain amount of money in forming a new company in the United States that will create a required number of jobs for U.S. citizens (EB-5)

Help with the Labor Certification Process

For most types of work immigration visas, you must have a job offer and your employer must complete a form called Alien Employment Certification. U.S. employers are not allowed to hire foreign citizens for U.S. jobs unless no qualified American worker is available. The employer's labor certification is part of your work immigration visa application. You must provide proof of the job offer, and the employer must describe in detail the attempts made to hire a U.S. citizen or permanent resident before offering you the job. Although Wolov & Felixon P.C. cannot help you find an employer, we can help with the labor certification process (also called the PERM process).
