Aggressive Representation at All Stages of Deportation Proceedings

The U.S. government can deport an immigrant for many reasons, including immigration fraud, conviction of certain crimes or helping with illegal entry into the United States. Usually, deportation proceedings begin with a Notice to Appear from U.S. Immigration and Customs Enforcement. You could also be arrested and detained by the Department of Homeland Security. If you are being detained, you have the right to a bond redetermination hearing to ask the judge to lower the amount of bail. You can appeal the bond redetermination hearing outcome to the Board of Immigration Appeals.

The next stage of the proceedings is the removal hearing, where a judge decides whether you may be deported. You should not go through a removal hearing without the help of an experienced immigration lawyer. Your lawyer may be able to:

  • Arrange for voluntary departure so you can avoid the black mark of formal removal and return to your home country or another country that allows you entry.
  • Get you "cancellation of removal" so you can stay in the U.S. To qualify, you must meet several strict requirements and prove that leaving the United States would be an extreme hardship for you and your immediate family.
  • Get you political asylum so you can stay in the United States as a refugee under either the Immigration and Nationality Act or the U.N. Convention Against Torture.
  • Argue for adjustment of status to lawful permanent resident, if you qualify.
  • Get a stay of removal to change the date by which you must leave the United States.
